Over the past 4 years, the crypto industry has shown active growth, and entrepreneurs realized that blockchain can be used not only for monetary transactions, but also in logistics, healthcare and jurisprudence.

On May 25, the event company Smile-Expo, for the first time held Blockchain & Bitcoin Conference Finland in Helsinki, where the speakers shared their experience of introducing blockchain into business models. Participants told attendees about the difficulties and challenges that they had to overcome while developing software or working with market regulators.

Gabriel Dusil, founder of Adel Ecosystem (Czech Republic)

Speaker talked about the prospects for the crypto industry development, as well as the main barriers to globalization that are built by the humanity and should be destroyed now.

According to Gabriel, society functions as a breeding system, and creates defensive barriers: economic, physical, state. And only after destroying these restrictions it is possible to unite the world. According to the speaker, cryptocurrency can cope with this task.

Nikolai Sondergaard from the Nordic Blockchain Association (Finland)

Nikolai outlined the main challenges of the crypto economy regulation in different jurisdictions, as well as told in detail about the advantages of blockchain against centralized databases. According to the speaker, one of the main advantages of distributed ledgers is global interaction and transparency.

Now Nikolai works in the Nordic Blockchain Association, which cooperates with the authorities for the blockchain implementation into social institutions.

Dinis Guarda, CEO and founder of the lifesdna medical startup (UK)

The speaker covered the main problems of blockchain, in particular, the 51/49 problems, when owner of most of the computing power can get control over the blockchain, as well as the rapid digitalization of the world. According to Dinis, some people are wary of blockchain because it can leave some people unemployed. However, not everyone understands that the advent of the new technology results in the need for new specialized personnel.

“Blockchain is a tsunami: you are either surfing at the top of the wave, or you'll be underwater and sink to the bottom!” Dinis said.

“The Blockchain and Bitcoin Conference Finland on May 25h was a surprise in some ways,” says Vesa Kevinen from Art of Crypt.

Crypto artist V E S A has been an exhibition participant at the conference and he talks about his impressions in his article.

The conference was visited by 150 people, and V E S A highlights good organization and coordination of event. He also emphasizes the passion coming from all the participants and believes that it was a meeting of “creative and entrepreneurial people who like to challenge the status quo and innovate.”

V E S A has not only presented his art at the exhibition but has also been a part of the audience, enjoying the presentations of crypto experts. Mentioning Stefano Virgilli, CEO at VOX.sg, V E S A believes his presentation was a “stunning resume from the financial world” and a “breath of fresh air about ICO’s”. The artist also noticed the “infectious energy” of Zachary Reece while listening to his presentation as well.

The final panel discussion of the conference happened to be especially interesting in Helsinki as “emotions got heated in between an audience member and the panelist Zachary,” writes V E S A. The debate was on the contradictory issue: leaving Bitcoin alone and letting it decide on its own regulation or massively adopting it through consumer protection? The argument was quite intense and with a lot of opinions coming from different sides. “The debate is tricky though, as in some ways it is the light bulb asking the candle for approval,” shares V E S A.

“It was good to shake off some old dust and the ep does illustrate well why my outlook is not necessarily compatible with current Finnish mindset regulation. Most topics, of course, are in positive forward motion, in an attempt to propel the conversation about our collective future forward,” V E T A finishes evaluation.

Bitcoin ja muut kryptovaluutat ovat nousseet nopean hinnannousun vuoksi sijoittajien ja markkinavalvojien kiinnostuksen kohteeksi.

Nykyisellään kryptovaluutoille ei ole omaa erityissääntelyä. Niiden ja ICO:jen eli uusien virtuaalivaluuttojen sijoittajille suunnattujen antien sääntely määrittyy valuuttojen ominaisuuksien mukaan. Kryptovaluutta voi siis olla lain silmissä esimerkiksi siirtokelpoinen arvopaperi, mutta esimerkiksi bitcoinilla ei ole arvopaperin tai virallisen maksuvälineen asemaa.

”Juristillekin on osin vaikea hahmottaa, mitkä lait asiaan täysin soveltuvat, koska ennakkotapauksia siitä, miten regulaattorit säädäntöä soveltavat, ei Suomessa vielä ole”, sanoo Fintech Finlandin hallitusjäsen ja Nestholman talousjohtaja Anu Honkalinna.

Honkalinna toimii neuvonantajana muutamassa ICO-projektissa. Tilanteiden tulkinnan hankaluuksista huolimatta hän ei näe tarvetta erilliselle kryptovaluuttojen sääntelylle.

”Lainsäädäntö arvopapereista on olemassa, mutta aiemmin ei ole tarvinnut miettiä sitä rajanvetoa, missä vaiheessa tällaisesta teknisestä innovaatiosta tulee arvopaperi.”

Honkalinna pitää tärkeänä, että aiemmin paljastuneista huijauksista huolimatta ICO-mallin käyttäminen pidettäisiin yrityksille mahdollisena. Parhaana reittinä tähän hän pitää vuoropuhelua alan toimijoiden ja sääntelijän välillä.
 

”ICO:jen mittakaava ei enää ole pieni, vaan puhutaan merkittävästä taloudellisesta ilmiöstä. Näkisin, että Suomella ei ole varaa jättää tällaista trendiä väliin”, hän sanoo.

Finanssivalvonta valvoo arvopaperimarkkinalain noudattamista. Kryptovaluuttojen vaihtopalvelut ja lompakkopalvelujen tarjoajat tulevat rahanpesusääntelyn piiriin, kun uusi EU:n rahanpesudirektiivi tulee voimaan. Lisäksi EU:ssa harkitaan tarvetta alan muulle lisäsääntelylle.

Yrityksille perustetussa neuvontapalvelussaan Fiva on viime syksystä lähtien vastannut joihinkin kymmeniin kryptovaluutta- ja ICO-kysymyksiin alkuvaiheen yrityksiltä, kertoo johtava digitalisaatioasiantuntija Hanna Heiskanen.

”Meiltä saatetaan kysyä esimerkiksi, millainen sääntely ICO:on soveltuu. Lisäksi on kysytty liiketoimintamalleista tai sijoituspalveluista, joissa sijoitettaisiin kryptovaluutoihin”, Heiskanen sanoo.

Myös mielipide, jonka mukaan alan toimintaa ei pitäisi säädellä yläpuolelta mitenkään, elää kryptovaluuttayhteisön piirissä vahvana.

Osa alan toimijoista on kuitenkin ymmärtänyt sääntelyn tärkeyden liiketoiminnalle. Epäselvä sääntely on osittain johtanut esimerkiksi siihen, että pankit saattavat karsastaa nyt jopa tilien avaamista kryptovaluutta-alan pienille yrityksille.

”Pankkien suhtautumiseen voi vaikuttaa se, että alan kauppapaikat ja muut toimijat eivät ole kenenkään valvonnassa ja rahanpesusääntely ei tällä hetkellä koske niitä”, Heiskanen arvioi.
